TESTIMONIAL PHOTO, VIDEO & QUOTE RELEASE TERMS AND CONDITIONS
WHAT ARE TESTIMONIAL PHOTOS, VIDEOS AND QUOTES?
When EF Education First (“EF”) sees or produces great images and videos and/or hears great quotes from the EF student experience, we want to share them with the world! EF employs a professional production team of photographers and videographers that travel and capture images and videos of real EF students. If you or your child is interviewed, photographed or video recorded by the EF production team, we will send you an email with the exact photo, video and/or quote that we would like to share. EF also looks to the images and videos you post or have already posted on social media platforms such as Instagram with an EF Related Hashtag. An “EF Related Hashtag” is a hashtag that consists of, or includes, an EF market name, EF campus name, EF location name, EF trademark or the name of an EF product or campaign. If we like a post on your feed on a social media platform such as Instagram, TikTok, Facebook, Twitter, Pinterest, YouTube or LinkedIn, we’ll send you a message asking for your permission to use a specific image, video and caption (that includes an EF-related hashtag) so we can share your experience with our customers, worldwide.
BY RESPONDING TO THE EMAIL FROM AN EF REPRESENTATIVE GRANTING PERMISSION (AGREEMENT) TO USE THE PHOTO, VIDEO OR QUOTE, YOU WARRANT AND REPRESENT THAT:
you or your parental guardian are at least eighteen (18) years of age;
you agree to EF’s use of your image, video or quote;
EF’s use of your images and videos does not infringe the rights of any third party or violate any law; and
that you have read and that you agree to these Terms and Conditions
BY RESPONDING TO THE MESSAGE FROM @eflanguageabroad INSTAGRAM ACCOUNT OR ANOTHER OFFICIAL EF BRANDED SOCIAL MEDIA CHANNEL WITH “#yesEF” (AGREEMENT) YOU WARRANT AND REPRESENT THAT:
you are at least eighteen (18) years of age;
you own all rights in and to your images and videos;
you have permission from any person(s) appearing in your images and videos to grant the rights herein;
EF’s use of your images and videos does not infringe the rights of any third party or violate any law; and
WHAT AM I AGREEING TO?
By giving your “agreement,” you are granting EF an unlimited, non-exclusive, assignable, sublicenseable, perpetual, worldwide right to use the selected image, video or quote. This means you give to EF an unlimited right (but not an obligation) to use the selected image, video or quote in digital and non-digital content, worldwide. For example, this could include using the image, video or quote on the EF website, in brochures, print materials, mobile apps, postings on social media accounts, merchandise, internal communication, or the use on billboards, posters, websites of EF agents as well as in EF campus locations, events, and digital and offline campaigns. Moreover, you indemnify, defend and hold EF (and any person acting on EF’s behalf) harmless from and against any claims, damages, liabilities, costs and in connection with use of the image, video or quote as described above.
WHO WILL SEE YOUR IMAGES, VIDEOS AND QUOTES?
When give your “agreement” via email or #yesEF, your image(s), video(s) and quote(s) will not be impacted in your social media account(s), however they may also be used around the world through EF’s social media accounts and other marketing properties. It’s a great way to show people how far you’ve traveled on your EF journey and to inspire them to do the same. In return for this potentially worldwide exposure you agree that EF has no further obligation to pay you for the use of your image(s), video(s) or quote(s) and the intellectual property rights contained therein, where used in accordance with these Terms and Conditions.
LIMITATION OF LIABILITY
When you respond with “agreement” to our email or message on social media, you create a legally binding license agreement between you and EF, including the following limitation of liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EF WILL NOT BE LIABLE FOR (i) any special, indirect, incidental or consequential loss, costs, damages, charges or expenses; or (ii) loss of profits, or (iii) loss of business, contracts, goodwill, business opportunities; or (iv) loss of income, anticipated savings; or (v) loss or corruption of data or information; or (vi) any degradation which occurs in relation to THE USE OF THE IMAGES, VIDEOS OR QUOTES AS DESCRIBED ABOVE, WHETHER ARISING IN TORT, CONTRACT OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
PERSONAL DATA
In connection with these activities, EF needs to collect and use certain personal data about you such as your name, username on social media platforms, age, images, videos, quotes etc. in order to enable us to properly manage and present your participation in promotional activities. For example, you have a right to know which data we process about you, to have incorrect data corrected and in certain cases to request that your personal data is deleted.
